Terms of service

Labology (“Labology,” “we,” or “us”) is committed to helping individuals understand and optimize their health and wellness through the analysis of physiological data and personalized health recommendations. These Terms of Service (“Terms”) govern your (“you” or “user”) access to and use of our products, software applications, and services (collectively, the “Service”) provided by Labology or its affiliates.

1. Acceptance of Terms

By accessing, browsing, purchasing, subscribing to, or using any part of the Service, or by clicking to accept or agree to these Terms, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and all related policies, guidelines, and disclosures incorporated by reference.
If you do not agree to these Terms, you must immediately discontinue use of the Service.

2. Scope of Services

Our Service includes, but is not limited to:

Collection and analysis of biological samples (e.g., blood, saliva);
Provision of personalized health insights based on sample analysis;
Access to recommendations related to health, nutrition, lifestyle, and supplementation.

3. Revisions and Updates

Labology reserves the right to change, revise, update, or modify these Terms or any related policies at any time. Changes will be effective as of the date stated at the top of these Terms and will be communicated by posting on our website or by email. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.

4. Ownership of Materials and Service

All content and materials available through the Service—including designs, text, graphics, images, videos, software, and data—are owned by Labology or its licensors and are protected by intellectual property laws.
You are granted a limited, non-exclusive, revocable license to use the Service and materials for your personal, non-commercial use only. Any other use requires prior written consent from Labology.

5. Software License

Subject to compliance with these Terms, Labology grants you a limited, non-exclusive, revocable license to use the software provided as part of the Service. You agree not to copy, modify, reverse engineer, decompile, or otherwise attempt to derive the source code of any part of the software.

6. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

7. Results and Medical Disclaimer

Results provided by Labology are for informational and educational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. You should consult a qualified healthcare professional before making any health-related decisions based on the results.
In cases requiring medical responsibility, Labology will refer you to our licensed medical partners in Switzerland, who will assume the medical responsibility.

8. Duration of Service

Unless otherwise specified, Labology’s service packages are valid for six (6) months from the date of the first analysis. Renewals are available through the purchase of additional packages.

9. Payment

Payments for the Service may be collected directly by Labology or via a third-party payment processor. You agree to provide accurate billing information and authorize Labology or its processor to charge your selected payment method.
You are responsible for any fees or charges incurred through the use of the Service.

10. Risks and Warnings

Participation in the Service may involve certain risks, including discomfort during sample collection and receiving recommendations that may not be suitable for your individual health status. Labology does not provide medical advice, and you should seek professional guidance before acting on any recommendations.

11. User Content

By submitting or posting content through the Service, you grant Labology a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, distribute, and display such content as necessary to provide and improve the Service.

12. Termination

Labology may suspend or terminate your access to the Service at any time without prior notice if you breach these Terms. Upon termination, your right to use the Service will cease immediately, and Labology may delete your account and associated data.

13. Privacy

Your use of the Service is subject to Labology’s Privacy Policy, which explains how we collect, process, and protect your personal data. By using the Service, you consent to the collection and processing of your data in accordance with our Privacy Policy.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Zurich, Switzerland.

These Terms constitute the entire agreement between you and Labology regarding the use of the Service. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
